Terms of Service

1. Service Description

NightDesk provides an automated out-of-hours call handling and notification service for UK-based tradespeople and small businesses. Our service captures caller information, transcribes messages, and delivers structured job details to designated engineers via WhatsApp or SMS.

2. Subscription and Billing

The NightDesk Starter Plan is billed at £99 per month on a recurring basis. Payment is processed automatically at the beginning of each billing cycle.

Additional services, such as the Overflow Add-On, are charged separately at £10 per job routed.

Enterprise Plans are priced based on individual business requirements and are subject to custom agreements.

3. Refund and Cancellation Policy

Customers may cancel their subscription within 7 days of the initial payment for a full refund. This 7-day refund window serves as a trial period for the service.

After the 7-day period, subscriptions continue on a monthly basis and may be cancelled at any time. Cancellations take effect at the end of the current billing period, and no refunds are provided for partial months.

4. Limitation of Liability

NightDesk is a call handling and notification service. We are not responsible for:

  • Missed jobs due to technical issues, caller errors, or service interruptions
  • Actions taken by customers or their engineers in response to job notifications
  • The quality, safety, or outcome of any trade work performed
  • Customer disputes, contractual issues, or payment collection related to jobs
  • Loss of revenue, business interruption, or consequential damages

Our service is provided "as is" and we make no guarantees regarding uptime, accuracy, or completeness of call transcriptions.

5. Service Availability

While we strive to maintain 24/7 service availability, NightDesk does not guarantee uninterrupted access. Scheduled maintenance, technical issues, or third-party service disruptions may result in temporary unavailability.

Customers are encouraged to maintain backup systems for critical business communications.

6. Acceptable Use

Customers agree to use NightDesk for legitimate business purposes only. Prohibited activities include:

  • Using the service for illegal activities or fraudulent purposes
  • Harassing, threatening, or abusing callers or NightDesk staff
  • Attempting to compromise the security or functionality of the service
  • Reselling or redistributing access to NightDesk without authorization

NightDesk reserves the right to suspend or terminate accounts that violate these terms.

7. Data and Privacy

Your use of NightDesk is subject to our Privacy Policy, which explains how we collect, use, and protect customer and caller data. By using the service, you agree to our data handling practices as outlined in the Privacy Policy.

8. Changes to Terms

NightDesk reserves the right to modify these Terms of Service at any time. Customers will be notified of significant changes via email. Continued use of the service after changes take effect constitutes acceptance of the updated terms.

9. Governing Law

These Terms of Service are governed by the laws of England and Wales. Any disputes arising from the use of NightDesk will be subject to the exclusive jurisdiction of the courts of England and Wales.
